Tenancy lawyer — bonds, notices and NCAT

The principal has been acting for tenants in the tribunal since 2012, at the CTTT and then NCAT, as an advocate with the Tenants Advice and Advocacy Services before admission, and tenancy fees are set against the amount in dispute.

  • A termination notice you think is invalid
  • Repairs that are not being done
  • NCAT applications and hearings

Questions people ask

The landlord. Fair wear and tear is not deductible, and a landlord cannot charge you for a new item to replace an old one — only its residual value.

Six months after the bond is paid out, not six months after the tenancy ends.

Often not. NCAT is designed to be used without one and you generally need leave to be represented. If the other side has a lawyer, that changes.

Only with 60 days written notice, only once in any 12 months, and not at all in the first 12 months of the tenancy. Since 31 October 2024 that applies to fixed-term agreements as well as periodic ones. If you say the increase is excessive you can take it to NCAT, but you have 30 days from the notice to apply.

Guides on this

Send this to the solicitor

Twenty minutes on the phone is at no charge, and if the answer is that you do not need a solicitor, that is what you will hear. Write it down instead if that is easier.

A mobile or an email — whichever you would rather we used.

Replied to the same business day. Sending this does not create a solicitor–client relationship — we act after a conflict check and a written engagement. If it is urgent, call 1300 992 219.
